Motorcycle Accident with No Contact – Who is at Fault?

I was on a motorcycle and had the right of way. A car approaching a stop sign entered the intersection in front of me. I laid my bike down and slid down the road. Although I never made contact with the car, I was hurt from sliding along the roadway. The other driver blames me for the accident as they claim I could have gone around them. Who is at fault? And can I seek payment of my medical bills and wages, payment for the damage to my motorcycle and compensation for my pain and suffering?

If the driver of the car did not stop at the posted stop sign and proceeded into the intersection when it was not safe to do so, they are at fault for the accident. You laid the bike down to prevent greater injury to yourself and to them. Their insurance company should pay for the damage to your bike, your medical bills, your wage loss, and compensate you for your pain and suffering.
