Motor Vehicle Accidents
Bucks County PA
Pedestrian Accident
Our 16 year old Tinicum, Pennsylvania Client was a passenger in a car travelling south on Route 611 in Tinicum Township,
Bucks County, Pennsylvania. The driver failed to see a vehicle stopped to turn left into a mini-mart/gas station, and struck
that vehicle in the rear.
Following the impact, our Client exited vehicle and walked to the shoulder of the roadway toward a grassy area to wait for
help to arrive. Another car was also southbound on Route 611, some distance behind the car crash scene. The driver failed
to observe the situation on Route 611. When he recognized that there were vehicles in the roadway, he swerved to the right,
traveling at a minimum of 55 mph when he began to skid, he ran onto the shoulder and then the grassy area, striking our 16
year old Client at a minimum speed of 47 mph.
Our Client was struck and thrown approximately 20 feet landing on her side and then rolling onto her back. She told
emergency personnel that she blacked out but remembered the incident. She was in serious distress. Her leg injuries were
evaluated at the scene and she was given oxygen and morphine for pain relief. She was transported as a trauma victim to St.
Luke's Hospital in Bethlehem. Both of her legs were severely broken. She remained in the trauma unit for weeks and
underwent a number of orthopedic surgeries. She was eventually transferred to Good Shepherd Rehabilitation Hospital in
Allentown, Lehigh County Pennsylvania.
Our Client's parents hired the law firm of Naftulin and Shick, P.C. to help their daughter seek compensation for her very
serious injuries. We made sure her medical bills were paid and she was able to receive the care and rehabilitation that she
needed.
The insurance coverage for the car in which our Client was a passenger at the time of the first collision and the
insurance coverage for the car that struck her as a pedestrian was not adequate to compensate our Client for her permanent
personal injuries. Our law firm also presented claims to her parents' underinsured motorist insurance company. All
available sources of recovery were exhausted to obtain compensation for this very injured Bucks County Pennsylvania
Client.
Monroe County PA
Car Accident - Stroudsburg
Our Stroudsburg Client was driving her Audi A6 in a southerly direction on Route 209 in Monroe County. She engaged her
left hand turn signal and stopped to turn into a parking lot. She was stopped on Route 209 waiting for northbound traffic to
pass so that she could safely negotiate a left hand turn. An employee of a towing company was driving his employer's FL60
Freightliner tow truck with a 19' rollback bed on Route 209, some distance behind our Client. Although other vehicles coming
from behind her had safely gone around the Audi, the driver was not paying attention to the roadway and traffic in front of
him, failed to stop and crashed into the back of our Client, pushing her into oncoming traffic where she was struck by a
minivan.
At the scene, our Client was scared, confused and in a lot of pain. There was blood running down the back of her head.
She described the scene as total confusion and she wanted to get out of there. She was ambulanced to Pocono Medical Center
in Stroudsburg, Monroe County, Pennsylvania.
She suffered many injuries to her head, back and body. Her head required sutures. She had a concussion. A disc in her
neck was herniated. Her left knee sustained a tear of the medial meniscus. She underwent a number of orthopedic surgeries
to correct the injuries to her knee. However, some of the injuries were permanent.
Prior to the accident, our Client worked as a nurse at Easton Hospital, Northampton County, Pennsylvania. She worked long
hours and was required to be on her feet and able to lift to care for patients. She tried to go back to work as a nurse at
Easton Hospital but was unable to do so. She was out of work due to the injuries she suffered for a long period of time.
Eventually she found a job as a school nurse at a Monroe County school.
Suit was filed in Monroe County Pennsylvania. Prior to trial, the insurance company for the car that caused the collision
agreed to mediation. The case was successfully mediated and our Client received compensation for her serious personal
injuries caused by the negligence of the other driver.
Northampton County PA
Car Accident - Easton
Our Client was operating his Jeep Cherokee on Northampton Street, Easton, Pennsylvania and was stopped to make a left-hand
turn. Two cars were right behind him. The second car behind him crashed into the back of the car right behind him, pushing
it violently into the back of our Client's vehicle. After getting out of their vehicles and talking to each other, both
other drivers fled the scene of the accident. One driver was apprehended by police and arrested for drunk driving. The
other was caught later and plead guilty to "accident involving damage to an attended vehicle, failed in the duty to give
information and render aid."
Our Client went to his home after the accident with back pain, right shoulder pain and neck pain. That evening he went to
the emergency room at Easton Hospital in Easton, Pennsylvania and was given x-rays and pain medication. He followed up with
an Easton orthopedic doctor. He had six months of physical therapy at a Northampton County Physical Therapy Center and was
given multiple pain medications. He also had three epidural injections by an Easton pain specialist. His neck pain resolved
but he still had constant pain in his low back with intermittent radiation down into his foot.
Our client underwent a spinal surgery by an Easton neurosurgeon. The surgery was not successful and a second surgery was
performed.
After the surgery, his Easton orthopedic surgeon determined that he could only work 1-2 hours a day. Based on this
evaluation, our Client could not perform any type of gainful employment.
Suit was filed in the Court of Northampton County. The insurance companies for both other drivers tendered their policy
limits which were not sufficient to compensate our Client for his very serious back injuries. Claims were made against our
Client's insurance company for underinsured motorist insurance benefits. Our Client received all available coverage from his
underinsured motorist insurance coverage to compensate him for the injuries he suffered because of the negligence of two
drunk drivers.
Northampton County PA
Tractor Trailer Accident
One early summer morning, our Bangor, Pennsylvania client was driving to work on Route 78 near Easton, Northampton County,
in his Jeep Wrangler. A 47 year old, married, father of two, he was returning to work as an arborist after a two week
vacation. A very physically fit individual, he enjoyed boating and water skiing on his recent trip.
He had left his home in very early to report to his job in New Jersey. The trip usually took him about an hour. It was
almost 5:00 a.m. and the sun was just rising. It was clear and dry. There was no sun glare or anything else hindering
drivers' views. The Jeep had a soft top that was not on that day as the weather was so nice.
Up ahead, a road crew was re-paving the highway. The three lane eastbound lanes of the highway were narrowing to two lanes
in the construction zone. As drivers approached the area, there were warnings to slow and move to the right. It was evident
that the traffic was slowing as brake lights were coming on.
An over the road operator was driving a tractor/trailer rig in the center lane some distance behind our client. Our client
slowed down but had not stopped when his Jeep was struck from behind by the 18 wheeler. The impact pushed him toward the
median. The Ford van was coming up on his left and he was pushed into the side of it. He was then hit again from the rear by
the tractor/trailer.
Despite wearing his seat and shoulder harness, our client's body was violently thrown around the inside of the Jeep. The
bucket seat broke; he hit the steering wheel, the windshield, and the dashboard; something struck and punctured the back of
his head.
Our client sustained serious injuries to his right shoulder, knee and low back. He had repeated surgeries to his knee. He
underwent a lumbar fusion followed by months of physical therapy. He will never return to his pre-accident employment as an
arborist. Nor will he enjoy activities such as boating, skiing and hunting as he did before he was injured.
The law firm of Naftulin and Shick, P.C. was hired to obtain compensation for our client and his family. Suit was filed in
Northampton County Court of Common Pleas. After lengthy litigation, both sides agreed to submit the case to a mediation where
it was successfully resolved. The settlement provides compensation to our Northampton County client for the injuries he
suffered as a result of the negligence of the trucking company and their driver.
